There are 7000 miles on his winter tires and they are less than a year old. I told him to contact the PO and get the warranty information on the tires. They are less than a year old, they have to have some sort of coverage. The damage on his right front tire:

Anything is driveable. How good are you at handling a blowout, and how much do you care about destroying your fender if it gives way?

The real question though, is does it have structural damage. From the picture, it looks pretty superficial. The giveaway will be if it starts to form a sidewall bubble or leak air - if the tire maintains its shape, you are at lower risk, and there is a chance it will be fine for a good long time. However, if there is hidden damage, you risk a blowout. Obviously, it should be replaced, but obviously we shouldn't do snonuts either.

DOT# (3810)? this tire is getting a bit old. As far as the crack, t could be just a flesh wound. If it's not deep, should be good, but it will probably not pass inspection

Given the DOT number on the side of the tire (3810), the tires are over 4 years old. Made in 2010. Did the PO tell him they were under a year old?

Tire was made in the 38th week of 2010, in the year of our Lort and Saviour, Cheesus Cristo.

Also, as ULY noted - the tire is over 4 years old (3810 means made 38th week of 2010). Tires generally don't last much more than 5 years in hot dry climates. Once you start seeing cracks from dry rot, it's time to replace.

yup yup 3810 means the tire was manufacture on the 38th week of 2010. We recommend tires to be replaced at the 5 year mark. Even if the tread is fine and the rubber looks good. Tires do expire

If the PO has receipts proving his story, you may get a new set from the tire store, warranty or not. Selling expired tires is really, really frowned upon in the eyes of the DOT.
